PENALTIES FOR DRUG DISTRIBUTION:
Class A Punishments:
First Offense
- not more than two years in jail
Second of Subsequent Offense
- up to 2 and 1/2 years in jail
- OR up to 5 years in prison
Class B Punishment:
First Offense:
- jail not more than 1 year
Second or Subsequent Offense:
- up to 2 years in jail.
Class D Punishments:
First Offense
- jail not more than 2 years
- OR fine of not less than $500 and not more than $5000
- OR both fine and imprisonment.
Second Offense
- not less than 1 or more than 1 and 1/2 years in jail (must serve a year)
- fine of between $1000 and $10,000 dollars
- OR both fine and jail
